Agreement to Our Legal Terms

We are Business Exports, Inc. ("Company," "we," "us," "our"), operating the website claw-set-up.com (the "Site") and the ClawSetup service (the "Service"). You can contact us by email at [email protected].

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Business Exports, Inc., concerning your access to and use of the Service. By accessing the Service, you agree to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Nature of Service

ClawSetup is a software configuration service. We configure and set up OpenClaw AI agent software on behalf of our clients. We do not develop, own, or maintain the OpenClaw software itself. OpenClaw is open-source software developed and maintained by its respective contributors.

Our service is limited to: initial consultation, software configuration, channel integration, skills installation, and testing. We are a configuration provider, not a software vendor.

2. AI Agent Liability — IMPORTANT

YOU ARE SOLELY AND FULLY RESPONSIBLE FOR ALL ACTIONS TAKEN BY YOUR AI AGENT, WHETHER THE AGENT IS HOSTED ON OUR SERVERS OR YOUR OWN.

By using our Service, you acknowledge and agree that:

  • AI agents may generate unexpected, inaccurate, or inappropriate outputs. You are responsible for monitoring and supervising your agent's behavior.
  • Any actions performed by your AI agent — including but not limited to sending messages, emails, making API calls, executing code, interacting with third-party services, or communicating with other people — are your sole responsibility.
  • Even when the AI agent is deployed on our servers ("hosted" plan), the responsibility for the agent's actions, outputs, and consequences lies entirely with you, the client.
  • We configure the software according to your specifications. We do not control, monitor, or take responsibility for what the AI agent does after configuration is complete.
  • You agree to indemnify and hold harmless Business Exports, Inc. from any claims, damages, losses, or expenses arising from your AI agent's actions or outputs.

3. Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranties or representations about the accuracy or completeness of the Service's content or the content of any third-party software configured as part of the Service. We assume no liability or responsibility for any:

  • Errors, mistakes, or inaccuracies in AI agent outputs
  • Personal injury or property damage resulting from AI agent actions
  • Unauthorized access to or use of our servers or any personal information stored therein
  • Interruption or cessation of the configured AI agent's operation
  • Bugs, viruses, or other harmful components transmitted by the configured software
  • Any loss or damage incurred as a result of the AI agent's actions

4. Payments and Refunds

We accept payment via Stripe (Visa, Mastercard, American Express, Discover).

  • Setup Fee: A one-time $500 USD setup deposit is required to begin configuration work.
  • Hosted Plans: Monthly hosting fees ($100–$500/month) are billed in advance and are non-refundable for the current billing period.
  • Refund Policy: The setup deposit is 100% refundable if you request a refund within 3 (three) days of work being completed and your AI agent is not responding or functioning for any reason. After the 3-day period, all payments are non-refundable.
  • Cancellation: You may cancel hosted services at any time. No refund will be issued for the current billing period. Service will continue until the end of the paid period.

5. User Registration

You may be required to register to use the Service. You agree to keep your password confidential and will be responsible for all use of your account and password. You must provide true, accurate, current, and complete registration information.

6. Prohibited Activities

You may not use the Service to:

  • Configure AI agents for illegal, harmful, or fraudulent purposes
  • Harass, abuse, or harm other persons through AI agent actions
  • Impersonate others or misrepresent your identity via AI agents
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to bypass, disable, or interfere with security features
  • Use the Service in a way that could damage, disable, or impair our infrastructure

7. Third-Party Software

Our Service involves configuring third-party open-source software (OpenClaw) and connecting to third-party AI model providers (OpenAI, Anthropic, Google, etc.). We are not responsible for the terms, privacy practices, availability, or performance of any third-party software or services. Your use of these third-party services is governed by their respective terms and policies.

8. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

9. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your AI agent's actions or outputs; (2) use of the Service; (3) breach of these Legal Terms; (4) any breach of your representations and warranties; (5) your violation of the rights of a third party.

10. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Service. We reserve the right to deny access to the Service to any person for any reason at any time, including for breach of any representation, warranty, or covenant contained in these Legal Terms, or of any applicable law or regulation.

If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

11. Governing Law

These Legal Terms shall be governed by and defined following the laws of the State of California, United States. Business Exports, Inc. and yourself irrevocably consent that the courts of California shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.
